Terms and Conditions
Dear customers,
by visiting or making a purchase in the online store https://www.exer-art.com (hereinafter: “Store“), you accept the General Terms and Conditions of Sale (hereinafter: “General Terms“) which are listed below. Please read them carefully and familiarize yourself with the rules. The store reserves the right to amend the General Terms and Conditions of Sale without prior notice.
General Terms
General Terms define the procedure for ordering, payment, delivery, return, and complaints for purchases made on https://www.exer-art.com/ (hereinafter: “Website“).
Subjects
The online seller is PR EXER ART, Mileševska 48, Belgrade (hereinafter: “Online Seller“). The customer is a person who visits the online store and chooses at least one product, puts the product in the basket and pays using a payment card.
Products and Prices
The customer is enabled to purchase all products found on the website, whereby the products correspond in all respects to the accompanying declarations (hereinafter: “Products“). The prices on the website include value added tax (VAT). The prices are in Serbian dinars (RSD), while visitors from foreign countries can see approximate prices in their currency. The prices are valid only for online purchases.
Orders
Products are ordered by adding to the basket displayed on the website. Orders are irrevocable after confirmation, except in cases and according to the procedure stipulated in applicable laws. If ordered products cannot be delivered in their entirety, online seller undertakes to deliver available products from the selected items, of which he will inform the customer by email.
Delivery
The goods will be delivered at the territory of Serbia or to a country selected by the customer during payment (link). Delivery at the territory of Serbia will be made within three to five working days from the moment of placing an order, or up to 10 days if the goods are delivered to the European region. Delivery may take longer than indicated above if online purchase confirmation is sent to the customer during weekends or public holidays.
The customer is under an obligation to sign the delivery note on reception as confirmation of delivery of the ordered products.
Payment
Only payment cards are accepted for purchase of the ordered products.
Payment is refunded to the same account that it was charged to, attached by the customer in the Cancellation of Purchase or Complaint Sheet.
Complaints
Upon delivery, the customer is obliged to check the delivered package in the presence of the courier. If visible damage is noticed on the delivered package (signs of tear and/or crushing), the customer is not obliged to accept the package. The online seller will inform the customer about the subsequent procedure in the shortest time possible. Collecting the customer identity (ID) card data is a new request of the Tax Administration. Customer’s personal data are processed only for the purpose of product replacement or return.

In the event that the customer is not satisfied with the decision on the complaint, the dispute can be resolved through an out-of-court consumer proposal, in accordance with Article 149 of the Consumer Protection Law, or through an out-of-court settlement of consumer disputes before a body authorized by the Ministry of Trade, Tourism and Telecommunications of the Republic of Serbia – https://vansudsko.mtt.gov.rs/adrbodies.
Cancellation of Purchase
Pursuant to the Consumer Protection Law, in every online purchase, the customer who is lawfully considered a consumer has the right to terminate the contract within 14 days from the day of reception of the goods, i.e. cancel the purchase. Collection of ID card data is a request from the Tax Administration. ID card data are processed only for the purpose of product replacement or return.
In case of purchase cancellation, the customer is obliged to fill out the request on this link and send it to the e-mail address complaints@exer-art.com.
Transportation costs in case of unilateral termination of the contract are borne by the customer. In case of withdrawal from the contract, the customer has the right to a refund. The paid amount is returned to the customer upon reception of the product, after the product is inspected and determined to be undamaged and correct. The customer is obliged to return the product without delay, no later than 14 days after the day of reception of the product. After the 14-day period, the product cannot be returned. The product must be returned in the correct and unused condition, and in the original, undamaged packaging.
The customer is responsible for malfunctioning or damage to the product done as a result of inadequate handling of the product, i.e. the customer is solely responsible for the reduced value of the product if it occurs as a result of inadequate handling which exceeds necessary handling to establish the nature, characteristics and functionality of the product.
Returns policy on case the purchased products do not fit
In case the customer receives the shipment and finds that the delivered goods do not correspond to the ordered items, an e-mail must be sent to complaints@exer-art.com no later than 24 hours after reception.
Following an approval of the customer support service, the purchased item can be replaced for another available item of the same size. The returned product must be unused and must contain all accompanying declarations.
The ordered product cannot be returned if it has been worn. Products must be returned in an unused condition, in the original, undamaged packaging, to the address: PR EXER ART, Magacin Emila Zola 30a, Belgrade, Serbia.
Purchased products must be returned no later than 14 days after reception. Shipping costs are borne by the customer, except in case the customer receives a defective or wrong item.
Intellectual Property
Content displayed on the website, such as pages, design details, texts, photos, logos, audio recordings and software are the property of the online seller and may not be used without their prior consent. All information available on the website is for informational purposes only, and may not be used for commercial purposes or distributed to third parties.
Comments, correspondence and other content posted by customers
Customers are free to comment on the products and send email messages to office@exer-art.com or the exer.art Instagram page. The store reserves the right not to publish comments that are malicious, contain obscene statements, spread hatred and discrimination, and in any way jeopardize the rights of others. Such comments will be removed without prior notice.
Impersonation and registration using someone else’s email address is not allowed. The Store can initiate appropriate legal proceedings against such activities.
Product description and pictures
The Store undertakes to describe all products as accurately as possible, as well as using authentic photos of the items. If the purchased product is not in compliance with the data listed on the website, i.e. the published declaration, the customer can return it in an unused condition according to the procedure described in Cancellation of Purchase, fill in the Declaration of withdrawal from the contract concluded at a distance, and the online seller will refund the payment.
Working Hours
Working hours of the Store are 00-24h, 7 days a week. In case of technical problems or during regular maintenance, the website may be unavailable for a short period of time, about which all users and customers will be informed.
Change (Update) of Website Data
The store reserves the right to change the data displayed on any part of the website at any time, without prior notice.
ORDERS AND PAYMENTS
Purchase in the EXER ART online store is easy. Below you can find all information on how to order the desired products.
Registrations
Online purchases can be made by all registered or unregistered persons. The registration process is simple and can be completed quickly in a few steps.
Finding the desired product
The desired product can be traced by searching through the main menu, selecting the artist, collection or color, as well as using the quick search field. When the desired product is found, click on its image to enter the detailed view page. The desired product is added to the online cart by choosing the option “Add to basket”. Repeat the process to buy more products and proceed to the “Payment” option.
Payments
Only payment cards are accepted for purchase of the ordered products.
Payment cards
Products purchased in the online store can be paid for using Visa, Mastercard/Maestro or Dina payment cards if they are approved for online payments by the issuing bank.
When using payment cards, after confirming the order the customer will be directed to the OTP portal to enter the payment card data and make the payment. If the transaction is successfully completed, the customer will be redirected to the exer-art.com page with a notification that the payment has been successfully completed. In case of an unsuccessful transaction, the customer will receive information about the failed payment and will be able to try again or choose another payment method.
When making payments using payment cards, the total price of the ordered goods will be reserved on the customer’s account and charged at the moment when the order is confirmed by the seller.
Delivery
Deliveries will be made three to five working days after placing an order. Deliveries will be made through Post Express courier service on weekdays, from 8:00 a.m. to 7:00 p.m.
Product availability
Stock status is updated once every 24 hours. The customer will be informed in a timely manner if an ordered product is sold out in the meantime.
Content of the basket
Content of the basket will be saved even if the customer leaves the online store. Considering that the stock status is updated once every 24 hours, the desired item may no longer be available upon customer return and selection of the “Payment” option. At that moment, the content of the basket will be refreshed automatically, and the customer will receive information about the availability of the desired items.
